Terms & Conditions
Terms and Conditions
Last updated: 21 August 2026
___________________________________________________________________________
These Terms govern your use of the Obiotrack Logistics website, customer app, and rider app. By booking a delivery, creating an account, or applying to ride with us, you agree to them.
1.Acceptance of terms
By accessing the Obiotrack Logistics website or using our customer and rider apps ("the Platform"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Platform.
2.Our service
Obiotrack Logistics provides pickup-and-delivery logistics services in Nigeria, connecting customers with full-time staff riders and independent commission-based partner riders for same-city and interstate delivery, errand runs, and business/bulk dispatch. We act as the platform coordinating these deliveries; we are not a public postal service.
3.Accounts & eligibility
- You must be at least 18 years old to create an account or book a delivery
- You agree to provide accurate, current information and to keep your login details secure
- You're responsible for all activity that happens under your account
- Riders must additionally meet the eligibility requirements in Section 8
4.Booking, pricing & payment
Prices shown on the app or website are estimates based on package size, distance, and rider type; the final price is confirmed by your assigned rider or our dispatch team before or at pickup, and may vary based on actual distance, waiting time, or additional stops.
Payment can be made by cash on delivery, bank transfer, or card, as available at checkout. For business accounts on invoiced billing, payment terms will be agreed separately in writing.
5.Delivery timeframes
Delivery times shown on the Platform (including "average pickup time" and tracking ETAs) are estimates, not guarantees. Actual times can be affected by traffic, weather, security situations, incorrect addresses, or recipient unavailability. We'll make reasonable efforts to keep you informed of significant delays.
6.Prohibited items
You may not use Obiotrack to send:
- Illegal drugs, weapons, ammunition, or explosives
- Counterfeit goods or stolen property
- Live animals, human remains, or hazardous/flammable materials
- Large amounts of cash, or bearer financial instruments
- Any item whose sale, possession, or transport is illegal under Nigerian law
Note: We reserve the right to inspect, refuse, or hand over to authorities any parcel reasonably suspected of containing a prohibited item, and to suspend accounts that violate this section.
7.Customer responsibilities
- Provide accurate pickup and delivery addresses and contact details
- Package items appropriately for transport
- Declare the value and nature of fragile, valuable, or unusual items at booking
- Be reasonably available at the pickup and delivery windows agreed with your rider
8.Staff & partner riders
Staff riders
Staff riders are direct employees of Obiotrack Logistics, engaged under a separate employment agreement covering salary, working hours, and benefits. These Terms apply to their use of the Platform in addition to their employment agreement.
Partner riders
Partner riders are independent contractors, not employees of Obiotrack Logistics. Partner riders use their own vehicles, choose their own working hours, and are paid on a per-delivery commission basis under a separate rider partner agreement. Nothing in these Terms creates an employment, partnership, or joint-venture relationship between Obiotrack and a partner rider.
All riders — staff and partner — must pass identity verification, address confirmation, and a background check before accepting deliveries, and must comply with traffic laws and our code of conduct while on a job.
9.Liability
We take reasonable care in vetting riders and handling deliveries, but to the fullest extent permitted by Nigerian law:
- Our liability for loss or damage to a parcel is limited to the lower of the item's declared value (if declared at booking) or the amount set out in our current insurance/claims terms
- We are not liable for indirect, incidental, or consequential losses (such as lost business, lost profits, or lost opportunities) arising from a delay or failed delivery
- We are not liable for loss or damage caused by inaccurate information provided by the customer, inadequate packaging, or prohibited items sent in breach of Section 6
Nothing in these Terms excludes liability that cannot be excluded under Nigerian law.
10.Insurance & claims
Every delivery includes basic loss/damage cover up to a value stated on the Platform at the time of booking. Customers may purchase additional cover for higher-value items. To make a claim, contact us within 48 hours of the expected delivery time with your waybill number and evidence of the item's value; we'll investigate and respond within a reasonable period.
11.Cancellations & refunds
You may cancel a booking before a rider is assigned at no charge. Once a rider has been assigned or has begun travelling to the pickup location, a cancellation fee may apply. Refunds for service failures (such as a lost parcel) are handled under Section 10.
12.Acceptable use
You agree not to: misuse the Platform to harass or defraud another user; provide false information about a package's contents or value; attempt to access another user's account; or interfere with the security or normal operation of the Platform.
13.Intellectual property
The Obiotrack Logistics name, logo, waybill design, and app content are our property or used under license. You may not copy, reproduce, or use our branding without written permission.
14.Suspension & termination
We may suspend or terminate your account if you breach these Terms, provide false information, misuse the Platform, or engage in fraudulent or unsafe conduct. You may close your account at any time by contacting us.
15.Governing law & disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or use of the Platform will first be addressed through good-faith negotiation with our support team, and if unresolved, may be submitted to the courts of Nigeria with competent jurisdiction, or to arbitration if the parties agree.
16.Changes to these terms
We may update these Terms from time to time. We'll update the "Last updated" date above, and for significant changes, notify you through the app, website, or email. Continued use of the Platform after changes take effect means you accept the updated Terms.
